Terms of Service

ALTITUDE MOTION MEDIA TERMS OF SERVICE

OVERVIEW

By booking services with Altitude Motion Media (“AMM”), you agree to the following Terms of Service. These terms are designed to ensure clear expectations, smooth collaboration, and a high-quality experience for all parties. Please read carefully before booking.

 

1. APPOINTMENTS & PROPERTY READINESS

To ensure the best results:

  • The property must be photo/video ready at the scheduled appointment time. This includes turning on lights, cleaning, removing clutter, and ensuring all areas are accessible.

  • The client is responsible for coordinating with sellers, tenants, builders, or contractors to ensure property access.

  • Pets must be secured or removed for safety.

  • AMM will not clean, move items, or stage any part of the property for liability reasons.

  • If the property is not ready upon arrival, a $75 same-day rescheduling fee will apply.

 

Scheduling Policy: AMM strives to honor scheduled times but reserves the right to adjust appointments due to travel logistics or other operational needs.

Hours: Our regular business hours are Monday–Thursday, 9:00am–5:00pm, and Friday, 9:00am–1:00pm. Appointments outside these hours may be available for an additional fee, but are not guaranteed.

 

2. CANCELLATIONS & WEATHER POLICY

  • Appointments can be canceled or rescheduled up to the day prior with no fee.

  • Same-day cancellations or rescheduling incur a $75 fee.

  • Weather-related rescheduling is allowed at no charge, but must be requested 24 hours in advance.

  • AMM may not provide drone services in rain, moisture, or high winds.

  • If unsafe weather arises during the shoot, AMM may pause or reschedule remaining services without charge.

 

3. TURNAROUND TIME & RUSH SERVICES

  • Standard photo delivery: Next business day by end of day.

  • Standard video delivery: 2–3 business days.

  • Same-day photo rush: $95 (subject to availability).

  • Next-day video rush: $125 (subject to availability).

 

4. PHOTO & VIDEO EDITING

  • Photos are delivered using natural light. Color variations may occur due to lighting conditions and will not be Photoshopped unless requested for an additional fee.

  • Requests for re-edits, intricate Photoshop work, or special editing details must be noted during booking.

  • Additional edits after delivery require a $75 minimum re-edit fee. Complex changes may cost more.

 

Floor Plans & Lot Lines: All measurements and lot lines are estimates for marketing purposes and are not guaranteed to be accurate.

 

5. TRAVEL & SQUARE FOOTAGE FEES

  • AMM covers a 10-mile radius from central Lincoln, NE. Mileage beyond this radius incurs a fee (calculated during booking).

  • Out-of-state shoots require a custom travel quote.

  • Large homes with greater square footage are subject to additional fees, visible during the booking process.

 

6. LICENSED MEDIA USAGE

  • AMM retains full copyright to all media.

  • Clients receive a limited license to use media for marketing and promoting the specific listing or project discussed at time of booking.

  • Media may not be sold, transferred, altered (except resizing), or used by third parties (builders, stagers, designers) without AMM’s written permission and licensing.

  • Reuse for new agents or expired listings requires a rebranding fee and permission from the original client.

  • Uploading AMM media to AI training platforms or services that scrape content is strictly prohibited.

 

7. PAYMENT & LATE FEES

  • Full payment is due upon delivery. Media will remain locked until payment is received.

  • Late payments are subject to $25/week at AMM’s discretion.

  • Accounts overdue 30+ days may incur $100/month or 15%/month fees.

  • Services cannot be booked if any balance is outstanding.

  • AMM reserves the right to notify your brokerage of unpaid invoices.

 

8. MEDIA RIGHTS & PROMOTION

  • AMM reserves the right to use any media created for advertising, promotional purposes, portfolio display, and social media.

  • Clients may post media to their own social and listing platforms strictly during the listing’s marketing period.

 

9. WORK PRODUCT OWNERSHIP

All content created by AMM is considered our intellectual property. Clients are granted a use license, not ownership. Unauthorized reproduction, editing, or sharing of AMM’s work without permission may result in termination of services and legal recourse.

 

10. PROPERTY OWNER APPROVAL

Clients must ensure they have permission from the property owner for photo/video services. AMM can provide a written approval form upon request. Clients may also be required to obtain neighbor consent if requested by AMM due to proximity or visibility issues.

 

11. LIABILITY & INDEMNITY

AMM is not responsible for damage, loss, or claims arising from access issues, property conditions, or improper use of media. The client agrees to indemnify and hold harmless AMM from all claims related to services rendered.

 

12. FORCE MAJEURE

AMM is not liable for delays or non-performance due to events beyond our control, including but not limited to natural disasters, illness, equipment failure, or government restrictions.

 

13. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Nebraska.

 

14. SEVERABILITY

If any provision of this agreement is found invalid or unenforceable, all remaining sections remain in full effect.

 

15. COMMUNICATION & MARKETING

By working with AMM, you consent to receive occasional email updates and newsletters. You may opt out at any time via the unsubscribe link in our emails.
